A city councilman who send in his oath of office has lost his seat. To make matters worse for his party, it mighthave waited too long to call a meeting to name a replacement. Republicans who control the Elkhart City Council are bickering with Democrats over who gets to fill the seat vacated by Demo- cratRod Roberson. About the only thing the two sides agree on is that Roberson forfeited his at-large seat when he turn in his oath by the end of January. Roberson, who was re-elected to the council in November, ex- plainedhow that happened.

Under the law, officials must take the oath and file it with the appropriate body within 30 days of the beginning of their terms. If they fail to do so, it has the effect of vacating the office. Roberson was sworn in Jan.

26 caucus to fill the seat. Council President Steve Bowers, a Republican, contends that the Democrats lost their claim to the seat when they failed to begin the caucus process within 10 days of the vacancy, as the statute seems to require. That deadline would have been Feb. 10. Under that circ*mstance, the statute shifts the power to replace Roberson to the remaining eight council members: six Republicans and two Democrats.

Metzler said a Feb. 10 deadline binding because he learn the seat was open until then. As for Roberson, he wants to keep the the people want me to serve, he said.

Joseph Darby, 49, was in a holding cell in the courthouse Friday morning when a deputy checkedon him.

Darby was waiting to be brought before Circuit Judge Steve Mershon on a motion to revoke his probation for robbery. Deputy Jerri Adams saw Darby facing the back wall of the holding cell, tearing at his eyes with both hands. By the time more deputies arrived to help subdue Darby, he had torn one eye out of its socket and was trying to get the other eye, Adams said. Darby was taken to University Hospital and was operated on before being released Sunday, said Shelly Hazle, a hospital spokeswoman. The burst eyeball could not be repaired.

Darby is being held on the medical floor in the Jefferson County Jail in lieu of a $35,000 cash bond. Darby had checked himself into Central State Hospital as recently as December, telling doctors he had suicidal thoughts and was hearing things, according to court records. But Adams and other deputies said Darby was not seen as a threat when he was placed in the holding cell Friday morning. Darby was indicted in July on a charge of second-degree robbery in the assault and robbery of a taxi driver, according to court records. He was sentenced to five years but received probation, which he is accused of violating.
