Gary Dewitt Odom and Sheila Swiney both were to go on trial for murder yesterday before Jefferson Circuit Judge Laurence, Higgins. But the trial with only one defendant, when Ms. Swiney pleaded guilty to killing Dunn outside a Lyndon grocery store in April 1980. Odom, a Floridian, and Ms.

Swiney, from Lenoir City, had allegedly stopped at the store to buy snacks after a long road trip. The store's owner allegedly feared that Odom might rob him and called police. Dunn and another officer arrived to question Odom and Ms. Swiney and a scuffle sued. Odom was allegedly wrestling with Dunn outside the grocery when Ms.

Swiney shot Dunn. Odom was also charged with murder because, under Kentucky law, an accomplice to a crime can be found guilty of the crime. To convict Odom, the prosecution will bave to prove that Odom helped, encouraged or commanded Ms. Swiney to kill Dunn. Ms.

Swiney is expected to be the prosecution's key witness. Ms. Swiney, a short, pudgy girl with long black hair, sat only a few feet from Odom yesterday but didn't look at her former boyfriend as she waited to make her guilty plea. Sixty-four years and 15 days after he was wounded, Andrew Carman of Mayfield has received his Purple Heart from the Army.

Carman was wounded by an artillery shell on Sept. 25, 1917, as he and other members of the 369th Regiment, 93rd Division the only all-black infantry unit in the Army at the time were making an advance on the Western Front in World War I. Carman suffered a broken nose and a fractured knee. It took five days to get him off the battlefield. He says two French doctors did a good job of setting his nose.

But, partly because of the knee injury, he walks with a cane. The wounded soldiers were given wound stripes and told that their Purple Hearts would be forwarded to them soon after their discharge from the service. Carman's Purple Heart arrived Oct. 10. It was Carman's determination to "wear his award a little while before I die," coupled with the work of the Graves County chapter of the American Red Cross, that finally landed him the award he deserved.

Carman said he has been sick lately, and while sitting around the house he began to think about things, including the Purple Heart he had never received. He got in touch with the Red Cross chapter last spring and with their assistance wrote the Army about the commendation. The Army wrote back requesting additional information. He furnished them with a copy of his discharge and other pertinent information, and was notified that he would be receiving his Purple Heart. "Mrs.

(Jeanette) Roberts and the local Red Cross get all the credit for helping me get this award," said Carman, a retired farmer. "If it wasn't for them, I still wouldn't have it. I guess the (Army) just overlooked it." Carman, who at 86 is active on various boards throughout the city and county, was 22 when he entered the service.
